Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the EstateIntel iOS application (the "Service") operated by EstateIntel ("us", "we", or "our").
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
EstateIntel provides landlords and property managers with tools to manage portfolios, track tenant listings, input lease agreements, and coordinate maintenance tickets. The Service is provided as-is on the Apple App Store, and features may change or undergo updates periodically.
3. Account and Device Security
Because all files and database items are saved directly on your local device storage (and synced via your private iCloud):
- You are solely responsible for securing your physical device, passcode, and iCloud login credentials.
- We cannot retrieve, recover, or reset lost data resulting from deleted databases, device losses, or iCloud access issues, as we do not have central server storage of your databases.
4. Acceptable Use
You agree not to use the Service for any unlawful activities, including storing fraudulent tenant details, violating local tenant-landlord regulations, or distributing unauthorized materials. You must ensure you possess proper consent to log tenant information under GDPR, CCPA, or applicable housing jurisdiction guidelines.
5. Intellectual Property
The Service and its original code, features, design layouts, and icons are the exclusive property of EstateIntel and are protected by international copyright, trademark, and other intellectual property laws.
6. Limitation of Liability
In no event shall EstateIntel, nor its developers, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, lease revenues, tenant logs, document data, or other intangibles, arising out of your use or inability to use the Service.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice inside the app updates. What constitutes a material change will be determined at our sole discretion.
